Government Shutdown is Now Tied for Longest

The current partial government shutdown is now tied for the longest shutdown in modern US history.

Several key departments and federal agencies are affected – including the Department of Homeland Security’s E-Verify system. While the system is unavailable, employers and their agents are unable to:

  • Create an E-Verify case
  • View or take action on any case
  • Resolve E-Verify Tentative Noncomfirmations (TNCs)

What Does This Mean for E-Verify?

The government has made the following changes to E-Verify policies during the shutdown period:

  • The “three-day” rule for creating E-Verify cases is suspended for cases affected by the unavailability of E-Verify
  • The time-period during which employees may resolve TNCs will be extended
  • The number of days E-Verify is not available will not count toward the days the employee has to begin the process of resolving their TNCs

What Should Employers Do?

Employers should continue to create and complete I-9’s through HIREtech’s platform as usual. Aside from the E-Verify process, the system will continue to operate normally. During the shutdown, all E-Verify transactions will be queued. Our system pings the E-Verify system every few minutes in attempt to complete the pending transactions. Once the E-Verify server begins accepting cases, all pending cases will be processed without delay.
