E-Verify Status and Government Shutdown

As you have likely heard by now, due to congress and the President being unable to agree on a new fiscal budget, parts of the government have been shut down and will remain so until a budget deal can be reached. As a consequence, the government E-Verify System is now inaccessible.

What are the details of the shutdown?
E-Verify and E-Verify services are currently unavailable due to a lapse in government appropriations. While E-Verify is unavailable, employers and their agents will not be able to access their E-Verify accounts to:

  • Create an E-Verify case;
  • View or take action on any case;
  • Resolve E-Verify Tentative Nonconfirmations (TNCs).

Will E-Verify be enforced during this time?
The government has made the following changes to E-Verify Policies:

  • The “three-day rule” for creating E-Verify cases is suspended for cases affected by the unavailability of E-Verify.
  • The time period during which employees may resolve TNCs will be extended.
    • The number of days E-Verify is not available will not count toward the days the employee has to begin the process of resolving their TNCs.

What do Employers Have to do?
Employers should continue to create and complete I-9’s through the HIREtech I-9 platform as normal. Aside from the E-Verify process, all features and benefits of the system will continue to function as normal. As long as the government E-Verify system is non-functional, all E-Verify transactions in the I-9 system are queued (accessible through the "Pending E-Verify" control on your dashboard), and the system automatically pings the E-Verify server every few minutes to attempt to complete these pending cases. Once the E-Verify server begins accepting cases, all open and pending E-Verify cases are processed and updated without delay.

Note as well that during the shutdown, employers may not take adverse action against an employee because the E-Verify case is in an interim case status, including while the employee’s case is in an extended interim case status due to the unavailability of E-Verify.
